1. Who provides the service

Madrugo (https://madrugo.com/en) is provided by Samuel Moreno Conejero, an individual established in Spain. These terms are the contract between you and that person.

2. Accepting these terms

By creating an account, using the app (/app) or using the iPhone, Mac or Apple Watch apps, you accept these terms and the Privacy Policy. If you do not agree, please do not use the service.

If you are a consumer, nothing here deprives you of the rights Spanish and European law give you.

3. What it is and what it is not

Madrugo brings the mail, calendar, tasks, reminders and weather forecast of the accounts you connect onto a single screen, and uses artificial intelligence to summarise your day, propose replies and extract tasks.

It is not a mail or calendar provider: it is a window onto yours. If Google, Microsoft, Apple, Todoist or tokidu change their API, restrict a permission or go down, Madrugo stops seeing that part until it is resolved.

4. Test status and pricing

Madrugo is in open testing: it is free, nothing is charged, and there is no commitment about availability or about features staying. Expect outages, bugs and changes without prior notice.

If a paid tier ever exists, its price, what it includes and how to cancel will be stated before you subscribe, and no charge will be activated without your express acceptance.

5. Minimum age

You must be at least fourteen. Below that age, Spanish law requires consent from whoever holds parental authority or guardianship (Article 7 of Organic Law 3/2018), and Madrugo is not built to request or verify it.

6. Your account and your connections

• You are responsible for your password and for the devices you pair. You can list and revoke paired devices at /app/settings.
• Each connection (Google, Microsoft, iCloud, calendars by link, Todoist, tokidu) is requested separately and read-only first: write access is requested when you take the action that needs it, and is never requested for tokidu. You can refuse or revoke it at any time. Telegram is only a channel to receive the summary: Madrugo reads nothing there and you can disconnect it whenever you like.
• Only connect accounts that are yours or that you are authorised to use. If you connect a work mailbox, make sure you are allowed to.

7. AI actions: you decide

What Madrugo writes is a proposal. Sending an email, deleting it, archiving it, creating an event or completing a task requires your confirmation, and reviewing the content before confirming is up to you.

A language model can get things wrong: misread a date, confuse one person with another or summarise misleadingly. Do not rely on a summary for an important decision without opening the original message.

8. Acceptable use

The following is prohibited:

• Using the service to send unsolicited bulk email or for any unlawful activity.
• Accessing other people's accounts or data without authorisation.
• Attempting to circumvent the app's limits, security mechanisms or encryption.
• Overloading the API with unauthorised automation.
• Reselling or commercialising access to Madrugo without written authorisation.

9. Suspension and ending

You can stop whenever you like: disconnect your connections and erase your data at /app/settings. The periods, and what deletes what, are in the Retention Policy.

We may suspend or close an account that breaches these terms or that puts the service or other people at risk. If that happens we will tell you, and you will be able to export your data first, unless the law prevents it.

10. Intellectual property

The design, trade marks, logos, code and content of Madrugo belong to the person who provides it, and using the account gives you no rights over any of it.

Your data is yours. Your emails, events, tasks, contacts and anything you enter remain yours, and you can export them as JSON whenever you want.

11. Liability

Madrugo is provided as is and subject to availability. We do not warrant that it will run uninterrupted or error-free, and we are not liable for outages or policy changes in third-party APIs.

This does not limit the rights the law gives consumers, nor liability for wilful misconduct or gross negligence, nor damage the law does not allow to be excluded. If you are a consumer and any clause in this section is unfair, it is treated as not written and the rest still applies.

12. Governing law, complaints and jurisdiction

Spanish law applies.

Write to [email protected] first: the intention is to resolve things without courts. If that is not enough and you are a consumer, you may bring the claim before the courts of your own domicile or those of the provider, as you choose; that jurisdiction cannot be contracted away against you. If you use Madrugo as a business or professional, the courts of Barcelona have jurisdiction.

For anything concerning data protection, the competent authority is the Spanish Data Protection Agency.

13. Changes to these terms

We may amend them. The version and date are at the top and changes take effect once published at https://madrugo.com/en/terms. If a change materially harms you, we will tell you in the app with reasonable notice, and you can stop using the service and erase your data.
